Photography License

1.1 Copyright Notice

All photographs, images, and related digital assets (including but not limited to processed images, RAW files, and associated metadata) displayed on this website are the exclusive intellectual property of Noctivision. They are protected under international copyright laws, treaties, and related regulations. All rights not expressly granted herein are reserved by Noctivision.

1.2 Definitions

“Non-Commercial Use” refers to any use that is not primarily intended for or directed towards commercial advantage, monetary compensation, or business promotion. This includes, but is not limited to: personal wallpapers, screensavers, private prints, non-commercial social media sharing, and personal educational projects.

1.3 Permitted Use

• Download and use photographs for personal, non-commercial purposes as defined above.

• Process and share specifically provided RAW files (e.g., CR2, ARW, NEF, DNG, TIF, FIT, FITS, XISF) for non-commercial purposes only. Any derivative works created from RAW files must be shared under the same license terms and include appropriate attribution.

1.4 Prohibited Use

• Commercial use of any photographs without prior written consent from Noctivision.
• Modification, editing, or reprocessing of photographs, except where RAW files are explicitly provided for that purpose. Derivative works from provided RAW files may not impose additional restrictions beyond this license.
• Redistribution, sublicensing, or hosting of photographs without clear attribution.
• Use of photographs in any manner that is defamatory, misleading, or illegal.
• Use of photographs in AI training datasets, machine learning models, or similar technologies without explicit permission.
• Use of photographs in NFTs, blockchain assets, or tokenized products without explicit permission.

1.5 Attribution Requirement

When sharing photographs publicly, you must include visible credit in the following format:
“Photo by Noctivision - noctivision.pages.dev”.
The attribution must be placed in a manner that is reasonably accessible to viewers.

1.6 Consequences of Violation

• Immediate revocation of your right to use the photographs.
• Formal takedown requests issued to hosting platforms and service providers.
• Legal action, including claims for actual damages, statutory penalties, and recovery of legal costs.

1.7 Disclaimer of Warranty

All photographs are provided “as is” without any warranty regarding accuracy, color performance, metadata integrity, or fitness for a particular purpose.

2.1 Copyright Notice

The website source code, design elements, layout, and associated assets provided on GitHub are the intellectual property of Noctivision, unless otherwise stated.
